Terms of Use
These terms explain how you may use the Raqeemly app, what you are responsible for, and the limits around support, backups, purchases, and liability.

Raqeemly ("Raqeemly", "we", "us", "our") is operated by a sole trader registered in New South Wales, Australia. Our identity and registration details are available from the Australian Business Register using the ABN below.

What these terms cover
These Terms of Use ("Terms") apply to your use of the Raqeemly mobile application ("the App") and the website at raqeemly.com ("the Site"). By downloading, installing or using the App, you agree to these Terms. If you do not agree, do not use the App.
If you are under 18, you should use the App with your parent or guardian's permission, as a person under 18 may not be able to enter into a binding agreement.
App store terms also apply
You obtain the App through the Apple App Store or Google Play. Those stores have their own terms, which apply to your download and to any purchase you make.
Where these Terms conflict with the applicable store's terms, the store's terms prevail to the extent of the conflict. Apple and Google are not parties to these Terms, have no obligation to provide support for the App, and are not responsible for the App or for any claim relating to it.
Your licence to use the App
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own purposes (including your own business purposes).
We own the App, the Raqeemly name and logo, and all associated intellectual property. Nothing in these Terms transfers any of that to you.
You must not:
copy, modify, translate, reverse engineer, decompile or disassemble the App, except to the extent this restriction cannot lawfully be imposed;
rent, lease, lend, sell, sublicense or redistribute the App;
remove or obscure any proprietary notices;
use the App to break any law, infringe anyone's rights, or scan documents you have no right to copy;
attempt to circumvent purchase verification or access paid features without paying for them.
Your documents remain yours
You keep all rights in the documents, images and text you create or store using the App.
The App is designed so that we cannot access your documents. Scanning, image processing, text recognition (OCR), search indexing and PDF creation happen on your device. We do not operate servers that receive, store or process your documents. See our Privacy Policy for full detail.
Because we have no copy of your documents, we cannot recover them for you in any circumstances.
Your responsibility for your own data
This is the most important practical clause in these Terms.
You are solely responsible for keeping your own backups of anything you need to keep, by exporting or sharing documents out of the App to a location you control. We strongly recommend you do this regularly for anything important.
Your documents are stored only on your device.
If you uninstall the App, your documents are permanently deleted.
If you lose, damage, reset, sell or replace your device, your documents are lost with it.
We have no backup, no copy, and no ability to restore anything.
Back up anything important. Once documents are removed from your device, Raqeemly cannot restore them.
Accuracy, and what you must not rely on the App for
The App uses automated edge detection, image enhancement and text recognition. These technologies are not perfect. Results vary with lighting, handwriting, image quality, page condition, language and layout.
You must independently check any output that matters.
The App is a scanning and filing tool. It does not provide legal, financial, taxation, accounting, medical or other professional advice, and no output of the App should be treated as such advice. If you need advice, consult a qualified professional.
You are responsible for deciding whether a scan is fit for the purpose you intend to use it for, and for verifying it before you rely on it, submit it, or destroy an original document.
Text recognition may be incomplete or wrong. Characters, numbers, dates and totals may be misread.
Enhancement may alter appearance. Contrast, shadow and colour processing changes how a document looks and may reduce the legibility of faint content.
A scan is not a certified copy. The App does not produce certified, notarised or legally attested copies of anything.
Purchases
The App is free to download and includes the free tier at no charge.
Optional paid upgrades are one-time purchases made through the Apple App Store or Google Play. Prices are shown in the App before you buy and vary by region.
Paid tiers do not expire, except any tier expressly described in the App as an annual subscription at the time you buy it.
We may change prices for future purchases. A price change never affects something you have already bought.
Payment is processed by Apple or Google. We never see or handle your payment card details.
Purchases are tied to your Apple or Google account, not to any Raqeemly account. You can restore a purchase on a new device by signing in to the same store account and using Restore Purchases in the App.
Refunds are handled by the store you purchased from, under that store's refund policy. We cannot issue refunds directly. Nothing in this clause limits any right you have to a remedy under the Australian Consumer Law (see clause 10).
Changes, availability and discontinuation
We may update, change or remove features of the App, and we may stop distributing or supporting the App entirely, at any time.
We do not guarantee the App will be available, error-free, uninterrupted, or compatible with every device, operating system version or future OS release. Operating system updates outside our control may affect how the App works.
If we discontinue the App, any copy already installed on your device will generally continue to work for as long as your device and its operating system support it, but we do not warrant this and have no obligation to maintain compatibility.
We may change these Terms. If we make a material change, we will update the effective date above and publish the change on the Site. Continuing to use the App after a change means you accept the updated Terms.
Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
Where a statutory guarantee applies and cannot be excluded, and where the law permits us to limit our liability for a failure to comply with that guarantee, our liability is limited to one or more of the following, at our option: replacing or repairing the goods, resupplying the services, or paying the cost of doing so.
Clauses 11 and 12 apply only to the extent the law allows.
Disclaimers
To the maximum extent permitted by law, and subject to clause 10:
The App is provided "as is" and "as available".
We give no warranties or representations other than those we cannot exclude, including no warranty that the App will meet your requirements, that its output will be accurate or complete, or that defects will be corrected.
We are not responsible for loss or corruption of your documents, however caused, including loss caused by device failure, device loss or theft, operating system faults, uninstalling the App, insufficient device storage, or your own actions.
Limitation of liability
To the maximum extent permitted by law, and subject to clause 10:
We are not liable for any indirect, incidental, special or consequential loss, or for loss of data, loss of profits, loss of revenue, loss of business opportunity, or loss of goodwill, arising out of or in connection with the App, however caused.
Our total aggregate liability to you for all claims arising out of or in connection with the App or these Terms is limited to the greater of (a) the total amount you paid us for the App in the twelve months before the claim arose, and (b) AUD 50.
Indemnity
To the maximum extent permitted by law, you agree to indemnify us against any claim, loss, liability or cost we suffer arising from your breach of these Terms, your misuse of the App, or your scanning, copying, storing or distributing material you did not have the right to scan, copy, store or distribute.
Suspension and termination
You may stop using the App at any time by uninstalling it. Uninstalling permanently deletes your documents from the device.
We may terminate your licence if you materially breach these Terms. On termination, you must stop using the App and delete it. Clauses 4 (ownership), 5, 6, 7, 10, 11, 12, 13 and 16 survive termination.
Third parties
The App uses a third-party service to verify purchases. That service receives limited technical information necessary for verification, described in our Privacy Policy. We are not responsible for the acts or omissions of Apple, Google, or any third-party service beyond our reasonable control.
Governing law
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them. If you are a consumer resident elsewhere, this clause does not deprive you of the protection of the mandatory consumer laws of your country of residence.
General
If any part of these Terms is found unenforceable, the rest continues to apply.
Our failure to enforce a right is not a waiver of that right.
These Terms are the entire agreement between you and us about the App, together with the Privacy Policy and the applicable store terms.
You may not assign these Terms. We may assign them, including as part of a sale or transfer of the Raqeemly business, on notice published on the Site.
